Terms and Conditions

These Terms form a binding agreement between EPAC and the parent, guardian or customer making a booking or payment. Please read them before registering or paying.

    MEMBERSHIP THREE-STRIKE NO-SHOW RULE

    If a player is a no-show for three confirmed EPAC Training Membership bookings within any rolling 12-month period, all three missed sessions become chargeable at $35 each. The third strike therefore triggers a total charge of $105 for the three qualifying no-shows. EPAC may also restrict booking privileges or suspend or terminate Membership for continued misuse.

    FOUNDING MEMBER RATE

    Founding Member pricing is conditional on uninterrupted active Membership and successful payment. If a Membership payment is missed, fails, is reversed, charged back or remains unpaid, the Founding Member rate is lost. Reinstatement or later rejoining is at the then-current applicable rate unless EPAC expressly agrees otherwise in writing.

    ACADEMY PROGRAMME COMMITMENT

    Academy instalments are a payment plan for the full Academy programme commitment, not a month-to-month Membership. Withdrawal, missed sessions, holidays, team conflicts, injury or non-attendance do not automatically cancel the balance due.

    SELECTION & PROGRESSION

    Training does not guarantee Academy selection. Academy participation does not guarantee EPAC FC selection. EPAC FC participation does not guarantee tournament selection, starting status, playing time, scouting exposure, college recruitment, a scholarship, professional opportunity or any specific sporting outcome.

    PAYMENT DEFAULT

    EPAC may suspend booking, training, Academy and EPAC FC participation while amounts are overdue. Reasonable payment reattempts may be made to the authorized payment method.

    WEATHER / AIR QUALITY / FACILITY CHANGES

    EPAC may relocate, delay, shorten, combine, modify or cancel activity because of heat, smoke, air quality, lightning, unsafe fields, facility closure or other safety or operational circumstances.

    LIABILITY RELEASE

    Participation in soccer carries inherent risks. The parent/guardian assumes those inherent risks and, to the fullest extent permitted by California law, releases EPAC from claims arising from ordinary negligence within the scope of the release. The release does not apply where liability cannot lawfully be waived, including gross negligence, reckless or intentional misconduct.

    1. Scope, Contract and Acceptance

    1.1These Terms apply to all coaching, training, education, development and playing services supplied by EPAC, including EPAC Training Membership, Development and Performance sessions, specialist sessions, Complete Goalkeeping, homeschool programmes, private and small-group coaching, camps, clinics, online sessions, performance analysis, EPAC Academy, EPAC FC / Club activities, tournaments, trips, events and related services unless separate written terms expressly state otherwise.

    1.2The person completing a registration, booking, electronic acceptance or payment is the contracting customer. For a participant under 18, that customer confirms that they are the parent, legal guardian, or otherwise have lawful authority to contract for the player and give the consents and authorizations contained in these Terms.

    1.3Programme-specific information communicated on an EPAC website, booking page, invoice, acceptance email, schedule, programme guide or written offer forms part of the agreement. If a direct conflict exists, the more specific written programme term applies to that programme, except that no verbal statement changes these Terms unless EPAC confirms the change in writing.

    1.4These Terms may be accepted electronically. A check-box acceptance, digital registration, completed booking, payment, signature, or continued participation after the Terms have been provided may evidence acceptance to the fullest extent permitted by law.

    1.5If more than one parent or guardian communicates with EPAC, EPAC may rely on instructions from the contracting customer or any person reasonably presented to EPAC as having parental or guardian authority, unless EPAC has been given clear written notice of a legal restriction or custody order relevant to the player.

    2. Parent/Guardian Authority and Player Information

    2.1Customers must provide accurate and current player information, including date of birth, emergency contacts, relevant medical conditions, allergies, medications, injuries, accessibility needs and any information reasonably necessary for safe participation or programme administration.

    2.2The parent/guardian must promptly update EPAC if any material information changes. EPAC may rely on the most recent information provided.

    2.3EPAC may refuse, pause or condition participation where required information, consent, payment, medical clearance or registration documentation has not been provided, where the player is not eligible for the selected programme, or where EPAC reasonably considers participation unsafe or operationally inappropriate.

    2.4The parent/guardian is responsible for ensuring the player is legally eligible to participate in any tournament, competition or external event and for timely supply of birth certificates, player cards, travel documents, waivers, roster information, insurance evidence or other documentation requested by EPAC or an event organizer.

    3. Programme Structure, Eligibility and Player Pathway

    3.1EPAC Training is the principal entry and development stage of the EPAC Player Pathway. Development sessions are intended for recreational, newer or developing players. Performance sessions are intended for competitive-level players. Specialist and goalkeeper sessions may have additional criteria.

    3.2EPAC alone determines whether a player is appropriately placed in Development, Performance, Academy, EPAC FC or another group. Placement decisions may consider age, ability, maturity, physical readiness, behaviour, position, group balance, safety and development needs.

    3.3EPAC may move a player between age groups, levels or session groups where reasonably considered beneficial or necessary. Published age bands are operational guides and do not create an absolute entitlement to a particular group.

    3.4EPAC Academy is selection-based. Selection may consider technical ability, game understanding, decision making, coachability, attitude, character, athletic profile, position, squad balance, attendance, conduct and long-term potential. Selection decisions are sporting judgments made by EPAC and are not subject to a guaranteed appeals process unless EPAC expressly provides one.

    3.5Academy places may be reviewed at any time and may be subject to periodic re-selection, continued performance, attendance, conduct, payment and compliance with programme standards.

    3.6EPAC FC / Club is a merit-based playing opportunity designed to complement, not replace, a player's existing team or club. EPAC FC does not ordinarily compete as a traditional week-to-week league club unless EPAC expressly announces otherwise.

    3.7No stage of the Player Pathway guarantees progression to the next stage. EPAC may change the pathway, selection model, capacity or programme structure prospectively where reasonably required.

    4. Registration, Bookings, Attendance and No-Shows

    4.1A player must be properly registered and, where applicable, have a confirmed booking before participating. All bookings remain subject to capacity, eligibility, coach availability, facility availability and the current booking rules.

    4.2Membership sessions may be booked up to the scheduled session start time where space remains available. A booking is secured only when confirmed through EPAC's booking system or directly by EPAC.

    4.3Customers must cancel bookings they cannot attend as early as reasonably possible. Booking multiple sessions without genuine intention to attend, repeated overlapping bookings, repeated late cancellation, or other misuse of booking access may lead to restrictions.

    4.4Membership three-strike no-show rule. A no-show occurs when a player fails to attend a confirmed Membership booking and the booking was not cancelled before its scheduled start time. Each qualifying no-show is one strike. If a player accumulates three strikes within any rolling 12-month period, all three qualifying missed sessions become chargeable at $35 each, for a total charge of $105 triggered on the third strike. The customer authorizes EPAC to charge the payment method on file for those amounts where legally permitted and properly disclosed.

    4.5EPAC may waive a strike in exceptional circumstances in its sole discretion. A waiver on one occasion does not create a right to future waivers.

    4.6Following a third strike or continued booking misuse, EPAC may restrict advance bookings, require pay-per-session booking, reduce booking access, suspend Membership privileges, or terminate Membership.

    4.7Late arrival reduces available coaching time. EPAC is not required to extend a session or provide a make-up, refund or credit due to late arrival or early collection.

    4.8Attendance records maintained by EPAC, its booking platform, coach register or access system will be treated as the primary administrative record unless a customer shows a clear error.

    5. Membership Billing, Payments and Founding Member Terms

    5.1All fees are payable in U.S. dollars at the price communicated at registration or purchase. Applicable taxes, payment processing charges, event fees, travel costs or third-party charges may be added where properly disclosed.

    5.2Where Membership operates as an automatically renewing or continuous service, the recurring amount, billing frequency, cancellation method, trial or discounted period if any, and other material renewal terms will be disclosed at sign-up. EPAC will obtain express affirmative consent and provide cancellation and reminder notices as required by applicable law.

    5.3The customer authorizes EPAC and its payment processor to charge the agreed recurring Membership fee and any other amounts expressly authorized by these Terms and the checkout disclosures, including qualifying three-strike no-show charges.

    5.4The customer must maintain a valid payment method and sufficient funds. EPAC may make reasonable reattempts to collect a failed payment and may request another payment method.

    5.5A failed, missed, reversed, disputed, charged-back or overdue payment may result in immediate suspension of booking, Membership, Academy or EPAC FC participation rights until the account is brought current.

    5.6Founding Member pricing is a conditional loyalty rate and not a permanent contractual entitlement. It remains available only while the relevant Membership remains continuously active and all payments are successfully made when due.

    5.7If a Membership payment is missed, fails, is reversed, charged back, remains unpaid, or the Membership is cancelled or lapses, the Founding Member rate is lost. Any reinstatement, continuation after lapse or later rejoining will be at the then- current applicable rate unless EPAC expressly approves a different rate in writing.

    5.8EPAC may change standard future Membership pricing by giving notice required by applicable law. A valid Founding Member rate will remain protected only while the conditions for that rate continue to be met.

    5.9Discounts, scholarships, vendor funding, sibling rates, promotional codes and other concessions may have separate eligibility criteria, cannot be combined unless EPAC expressly permits it, and have no cash value.

    6. Cancellation, Refund, Credit, Freeze and Transfer Rules

    6.1Membership cancellation. Customers may cancel future Membership renewal through the cancellation method provided at sign-up or another easy-to-use method provided by EPAC. Where enrollment occurred online, EPAC will provide online cancellation to the extent required by California law.

    6.2Cancellation stops future billing after any amount already due or properly processed. Unless required by law or expressly agreed by EPAC, there is no prorated refund for a partially used billing period.

    6.3Membership fees purchase access to eligible programme inventory during the billing period, not a guaranteed number of attendances. Holidays, club conflicts, school commitments, voluntary absence, illness or inability to attend preferred times do not automatically create a refund or credit.

    6.4Memberships may not normally be paused or frozen. EPAC may, in its sole discretion, approve a temporary medical freeze where supported by appropriate documentation. Any approved freeze, length, payment treatment and return date must be confirmed in writing by EPAC.

    6.5Memberships, Academy places, programme credits and booked sessions are personal to the registered player and may not be sold, assigned or transferred to another person without EPAC's written approval. Credits are not transferable between siblings unless EPAC expressly approves the transfer.

    6.6For one-off sessions, clinics, camps, private coaching and other non-Membership services, the cancellation policy stated at booking applies. If none is stated, customer cancellations made within 24 hours of the scheduled start or a no-show are non-refundable.

    6.7If EPAC cancels a separately paid one-off service and cannot reasonably provide a replacement or equivalent service, EPAC may provide a make-up, credit or refund as appropriate. Membership customers do not automatically receive a prorated cash refund for a cancelled Membership session where reasonable alternative sessions remain available.

    6.8Approved refunds are normally returned to the original payment method. Non-refundable processing fees or third-party charges may be deducted or excluded to the extent permitted by law and properly disclosed.

    6.9Obvious pricing, schedule, capacity or description errors may be corrected by EPAC. If an error materially affects a paid booking, EPAC may offer the customer the corrected service or a refund of the affected amount.

    7. Academy-Specific Terms

    7.1Academy acceptance reserves a limited place for a defined programme period. The stated Academy fee is the total programme commitment. Any instalment arrangement is a payment plan for that total fee and is not a month-to-month right to terminate without further payment.

    7.2Except where required by law or expressly agreed by EPAC in writing, withdrawal, missed sessions, holidays, team conflicts, relocation, injury, illness, dissatisfaction, school events or a decision to stop attending do not automatically cancel remaining Academy instalments or create a refund.

    7.3EPAC may offer a make-up session, banked session, alternative training opportunity, credit or other accommodation at its discretion. Such accommodation is not an ongoing contractual entitlement.

    7.4Academy players may receive access to eligible EPAC Training Membership sessions as part of their Academy package where stated. That access remains subject to eligibility, capacity, booking, conduct, payment and no-show rules.

    7.5EPAC may change Academy groups, coaches, times, curriculum sequence, squad composition, session format and assessment methods where reasonably necessary for programme operation or player development.

    7.6Academy participation does not guarantee EPAC FC selection, a place in any tournament squad, playing time, a particular position, captaincy, external scouting exposure, college recruitment, scholarship, professional contract or future Academy place.

    7.7EPAC may withdraw an Academy place for serious or repeated misconduct, safeguarding concerns, persistent non- attendance, failure to meet programme standards, or non-payment, subject to applicable law and the financial terms of this agreement.

    8. EPAC FC / Club, Events and Travel Terms

    8.1EPAC FC selection is merit-based and event-specific. Selection for one match, squad, tournament, trip or age group does not create a right to future selection.

    8.2Selection, roster size, starting line-up, position, captaincy, substitutions, playing time and age-group placement are coaching decisions. Developmental playing-time aims may be communicated, but no minimum playing time is guaranteed unless EPAC expressly states otherwise in writing for a specific event.

    8.3A player may train or compete with older or younger players where rules permit and EPAC considers it appropriate for development, squad needs or safety.

    8.4Where EPAC FC participation itself is stated to be free, families remain responsible for personal expenses and any separately disclosed travel, accommodation, meals, passports, visas, insurance, transport, uniform replacement, tournament, registration or third-party costs.

    8.5If a parent accepts a tournament, trip or event and EPAC then incurs a non-refundable player-specific cost in reasonable reliance on that acceptance, the customer is responsible for that disclosed cost if the player later withdraws, unless EPAC is able to recover it or the withdrawal results from circumstances for which applicable law requires different treatment.

    8.6Parents are responsible for transport, accommodation and supervision during travel unless EPAC expressly confirms in writing that it is providing a particular element of travel or supervision.

    8.7Parents must manage conflicts with the player's existing club or team and comply with obligations owed to third parties. EPAC is not responsible for sanctions, missed club activity or disputes caused by a family's decision to participate in EPAC activity.

    8.8External tournament organizers, leagues, venues and governing bodies may impose separate rules, waivers, roster limits, eligibility conditions or disciplinary procedures. Participation may be conditional on compliance with those requirements.

    9. Drop-Off, Collection, Supervision and Transportation

    9.1Parents/guardians are responsible for safe and timely drop-off and collection. EPAC supervision ordinarily begins when the player is formally received by EPAC staff at the published session check-in time and ends when the player is released at the published end time to the parent/guardian or an authorized collecting adult.

    9.2EPAC is not a childcare service outside scheduled programme hours. A parent must not leave a child unattended at a venue before EPAC supervision begins or fail to arrange timely collection after it ends.

    9.3Parents must identify adults authorized to collect a child where requested. EPAC may require identification or refuse release where staff reasonably doubt a person's authority to collect.

    9.4An older player may arrive or depart independently only where the parent/guardian has given prior written permission or where EPAC has a documented programme rule permitting independent arrival/departure.

    9.5If a player is not collected on time, EPAC may contact the parent, emergency contacts, venue security, law enforcement or child protection authorities as reasonably necessary. Repeated late collection may result in fees, participation restrictions or termination after notice.

    9.6Unless expressly arranged by EPAC in writing, transportation provided by parents, other families or third parties is outside EPAC's control and responsibility.

    10. Player, Parent and Spectator Conduct

    10.1Players must act respectfully, follow coach and facility instructions, demonstrate sportsmanship, use equipment appropriately, and refrain from bullying, harassment, discrimination, threats, fighting, abusive language, deliberate dangerous conduct, theft, vandalism or material disruption.

    10.2Parents, guardians and spectators must treat players, staff, officials, opponents, other families and venue personnel respectfully. Abusive, intimidating, discriminatory, threatening, aggressive or confrontational conduct is prohibited.

    10.3Parents and spectators must not interfere with coaching, enter playing areas without permission, aggressively confront officials or coaches, or repeatedly undermine reasonable programme instructions. EPAC may establish sideline rules for specific activities.

    10.4Online and social media conduct directed at EPAC players, staff, officials or families must not be abusive, harassing, threatening, discriminatory, knowingly false or unlawfully defamatory. Nothing in this clause prevents lawful, good-faith complaints or reviews.

    10.5Serious conduct may result in immediate removal without prior warning. Less serious or repeated concerns may be managed through verbal warning, written warning, behavioural conditions, temporary suspension or termination.

    10.6A parent's or spectator's conduct may affect the player's continued participation where EPAC reasonably concludes that continued involvement would materially undermine safety, safeguarding or programme operation.

    11. Safeguarding, Anti-Bullying and Communications

    11.1EPAC is committed to a safe youth-sport environment. Safeguarding, welfare, bullying, harassment and discrimination concerns should be reported promptly to EPAC so that appropriate action can be considered.

    11.2EPAC may report suspected abuse, neglect, threats, criminal conduct or serious safeguarding concerns to law enforcement, child protection authorities, a governing body, venue operator or other appropriate authority where required or reasonably appropriate.

    11.3Coach communications concerning minors should ordinarily include or be accessible to a parent/guardian and should use appropriate professional channels. EPAC may establish communication rules for team chats, apps, video calls or direct messaging.

    11.4Parents and players must not record or share private changing, medical, safeguarding or one-to-one welfare conversations without appropriate permission.

    11.5EPAC may restrict access to changing areas, player meetings, technical areas, training spaces or online sessions to protect safety, privacy and the coaching environment.

    12. Health, Medical Disclosure and Emergency Care

    12.1Soccer and athletic training involve physical exertion and inherent risks. The parent/guardian is responsible for determining that the player is fit to participate and for obtaining appropriate medical advice where necessary.

    12.2The parent/guardian must disclose relevant medical conditions, allergies, medications, asthma, prior serious injuries, recent concussion, cardiac history, activity restrictions and other information that could reasonably affect safe participation. Updates must be provided promptly.

    12.3A player who is ill, contagious, feverish, vomiting, experiencing significant respiratory symptoms, or otherwise unfit to participate should not attend. EPAC may refuse or end participation where a player presents a material health or safety concern.

    12.4EPAC staff are coaches and are not acting as physicians, physical therapists, athletic trainers or other licensed medical professionals unless expressly identified as such. Coaching observations and performance information are not medical advice.

    12.5EPAC may stop, restrict or modify participation where staff reasonably believe a player is injured, unwell, unsafe to continue or requires medical assessment.

    12.6If a parent/guardian cannot be reached during a medical emergency, the parent/guardian authorizes EPAC to contact emergency services and to obtain or facilitate reasonably necessary emergency treatment for the player. The parent/guardian is responsible for ambulance, hospital, physician and related charges not otherwise payable by EPAC.

    12.7Parents are responsible for maintaining appropriate health and accident insurance. EPAC does not represent that any insurance held by EPAC will cover a participant's personal medical expenses.

    13. Concussion, Head Injury and Return to Play

    13.1Any player who is suspected by EPAC staff of sustaining a concussion or significant head injury may be immediately removed from activity and shall not be permitted to return that day merely because symptoms appear to improve.

    13.2EPAC may require written clearance from an appropriately licensed healthcare provider before a player returns to training or competition following a suspected concussion or significant head injury.

    13.3Parents must not knowingly send a player to participate contrary to medical advice or while experiencing unresolved concussion symptoms. Parents must promptly tell EPAC of any concussion sustained outside EPAC activity that may affect participation.

    13.4Where applicable law, event rules or EPAC protocol imposes a more specific return-to-play process, that process will apply.

    14. Sudden Cardiac Arrest and Serious Medical Symptoms

    14.1A player who faints or experiences unexplained syncope, chest pain, unusual shortness of breath, racing or irregular heartbeat, seizure-like activity, or other symptoms reasonably suggestive of a serious cardiac condition may be removed from activity immediately.

    14.2EPAC may require medical evaluation and written clearance before return to participation following symptoms reasonably associated with sudden cardiac arrest risk.

    14.3Parents must disclose known cardiac conditions, relevant family cardiac history or medical restrictions that could affect safe participation and must not permit participation contrary to medical advice.

    14.4EPAC may activate emergency medical services whenever staff reasonably believe a serious or life-threatening condition may exist.

    15. Heat, Air Quality, Weather, Facilities and Force Majeure

    15.1Outdoor sport is weather and facility dependent. EPAC may delay, relocate, modify, shorten, combine, postpone or cancel activity because of extreme heat, smoke, poor air quality, lightning, rain, wind, unsafe playing surfaces, field closure, inadequate lighting, facility restrictions or other safety concerns.

    15.2EPAC may use reasonable judgment, published public-health or sports guidance, venue instructions and available weather or air-quality information when deciding whether and how activity proceeds.

    15.3EPAC may modify work-to-rest ratios, reduce intensity, add hydration breaks, change clothing requirements, move indoors or alter content where reasonably necessary for safety.

    15.4EPAC may change venues, coaches, session times, age-group combinations, field allocations or programme schedules for operational reasons. Reasonable notice will be provided where practicable, but short-notice changes may be necessary.

    15.5Force majeure. EPAC is not liable for failure or delay caused by circumstances outside its reasonable control, including wildfire, severe weather, natural disaster, public-health event, government restriction, utility failure, transportation disruption, civil disturbance, labor disruption, facility closure or similar event. EPAC will use reasonable efforts to provide an alternative, credit or rescheduling solution where practical, but a cash refund is not guaranteed unless required by law.

    16. Coaching Services, Coaches, Groups and Programme Changes

    16.1A booking is for an EPAC service, not for an irrevocable right to a particular named coach, unless the booking expressly states otherwise. EPAC may substitute appropriately qualified staff because of illness, scheduling, staffing or operational needs.

    16.2EPAC may combine or divide groups, change group size, alter session content, move players between groups or cancel a low-attendance session where reasonably necessary. EPAC will seek to maintain an appropriate coaching environment but does not guarantee a fixed group composition.

    16.3EPAC may adjust curriculum, terminology, technology, session topics or delivery methods as coaching needs evolve.

    16.4Specialist sessions are intended to develop particular areas of performance, but EPAC does not guarantee that every session will contain identical drills, durations or coaching methods.

    16.5No statement by EPAC staff should be interpreted as a guarantee of selection, performance improvement, scholarship, college recruitment, academy placement, professional contract or other outcome unless expressly set out in a signed written agreement.

    17. GPS, Video Analysis, Performance Data and Technology

    17.1EPAC may use GPS wearables, video analysis, attendance systems, player review tools and other performance technologies. Data may include distance, speed, movement, training load, attendance, video clips, tags, coach observations and development notes.

    17.2Performance data is used for coaching, player development, programme administration, education and review. It is not medical advice and may contain measurement error or incomplete information.

    17.3The parent/guardian consents to reasonable collection and processing of such performance information for programme purposes, subject to applicable privacy law and EPAC's privacy disclosures.

    17.4EPAC may share relevant performance information with the player and parent/guardian and, where appropriate and authorized, EPAC staff, coaches, analysts or service providers supporting the programme.

    17.5Technology may fail, devices may be unavailable, and historical data may be lost or inaccessible because of hardware, software or third-party service issues. EPAC does not guarantee continuous availability or perfect accuracy of any technology service.

    17.6EPAC may replace or discontinue a technology provider or performance tool without creating a right to refund where the core coaching service continues.

    18. Privacy, Third-Party Platforms and Data

    18.1EPAC may collect personal information reasonably necessary to register players, process payments, communicate with families, manage safety, deliver coaching, analyze performance and administer events.

    18.2EPAC may use third-party booking, payment, email, messaging, video, cloud storage, GPS, analytics, form, website and other service providers. Those providers may process information subject to their own privacy terms and applicable law.

    18.3EPAC will handle personal information in accordance with applicable privacy law and any privacy notice or policy made available to customers. Where a separate Privacy Policy exists, it is incorporated by reference to the extent stated in that policy.

    18.4Parents should avoid sending sensitive medical, identity or payment information through public social media channels. EPAC may direct customers to a more secure channel.

    18.5Where legally required, EPAC may retain records for accounting, safeguarding, insurance, dispute resolution, tax, operational or compliance purposes after participation ends.

    19. Photography, Video and Media

    19.1EPAC may record sessions, matches or events for coaching analysis, safeguarding review, coach education and programme administration. Where such recording is reasonably necessary to provide an advertised performance-analysis service, participation may require the recording necessary for that service.

    19.2Promotional and marketing use of an identifiable child's image, voice or video should be subject to the media consent choices presented by EPAC. Parents who do not consent to promotional use should use the applicable opt-out or notify EPAC in writing.

    19.3EPAC will use reasonable efforts to honor a promotional media opt-out prospectively, but cannot guarantee removal of incidental crowd or background imagery already lawfully captured or content already published before the opt-out was received.

    19.4Parents and spectators must respect the privacy of other children. EPAC may prohibit or restrict photography, livestreaming or recording in changing areas, medical situations, online meetings, private player reviews or any setting where recording presents a safeguarding or privacy concern.

    19.5No parent or third party may commercially exploit EPAC-created footage, analysis, graphics or photographs without EPAC's written permission unless they independently own the relevant rights.

    20. Kit, Equipment and Personal Property

    20.1Players must arrive with appropriate footwear, shin pads, water and any other required personal equipment. EPAC may prevent participation where required safety equipment is missing.

    20.2Players are responsible for their own phones, bags, clothing, footwear, water bottles and personal property. EPAC is not responsible for loss, theft or damage except to the extent caused by EPAC's legally established responsibility.

    20.3Where programme kit is provided, the player must follow applicable kit rules. Replacement for lost, damaged, outgrown or additional kit may be chargeable.

    20.4Where EPAC provides different kit associated with pathway progression, such kit is issued only when the player satisfies the relevant EPAC progression criteria and any published programme conditions. Kit does not itself create or prove permanent status within a programme.

    20.5EPAC equipment must be used only as instructed and must not be deliberately damaged or removed without permission. The customer may be responsible for reasonable replacement cost for deliberate or reckless damage caused by the player.

    21. Intellectual Property and EPAC Brand

    21.1EPAC names, logos, marks, designs, coaching curriculum, session plans, graphics, documents, videos, analysis templates, photographs and original content are owned by or licensed to EPAC and are protected by applicable intellectual property law.

    21.2Participation or receipt of EPAC kit does not grant a right to create merchandise, commercial advertising, camps, coaching services, social media accounts or other businesses using EPAC branding or confusingly similar branding.

    21.3Customers may share ordinary personal photographs of their child wearing EPAC kit in a non-commercial manner, provided they do not falsely imply authorization, partnership or endorsement beyond the player's genuine participation.

    21.4EPAC materials may not be copied, resold, distributed, published or used to train or operate a competing commercial programme without written permission.

    22. Payment Disputes, Chargebacks and Outstanding Balances

    22.1Customers should contact EPAC promptly if they believe a charge is incorrect so that the matter can be reviewed before a payment dispute or chargeback is initiated.

    22.2Nothing in these Terms prevents a customer from exercising lawful cardholder, bank or consumer rights. However, a chargeback or payment reversal does not extinguish a valid underlying debt.

    22.3Where EPAC reasonably believes an amount remains validly due after a payment reversal or failed charge, EPAC may suspend future participation and booking privileges while the balance is investigated or remains unpaid.

    22.4The customer is responsible for reasonable, legally recoverable costs caused by deliberate payment fraud, unauthorized use of another person's payment method, or bad-faith conduct, but not for penalties prohibited by law.

    22.5EPAC may decline future services to accounts with unresolved material balances or repeated payment disputes unrelated to a genuine billing error.

    23. Complaints, Discipline, Suspension and Termination

    23.1Questions or complaints should be raised promptly with EPAC so that they can be reviewed while relevant information is available. Parents should not confront coaches during active player supervision or matches in a way that disrupts safety or programme delivery.

    23.2EPAC may investigate complaints by speaking with staff, players, parents, witnesses, venues, officials or other relevant persons and may review available video, messages, attendance records or other programme information.

    23.3EPAC may impose conditions, warnings, booking restrictions, temporary suspension or termination for non-payment, repeated no-shows, misconduct, abusive behaviour, safeguarding concerns, unsafe behaviour, repeated rule breaches, misuse of booking systems or other material breach.

    23.4Serious safety, safeguarding, violence, threats, harassment, discrimination, theft or abusive conduct may result in immediate removal or termination without prior warning.

    23.5Where EPAC terminates solely for its own convenience and the customer has prepaid for a specific unprovided service, EPAC will provide an appropriate credit or prorated refund for the unprovided portion. Where termination results from customer or participant breach, misconduct or non-payment, refunds are not guaranteed except where required by law.

    24. Assumption of Risk, Release and Waiver of Liability

    Important liability provision

    This section affects legal rights. It should be read carefully before accepting these Terms or allowing a child to participate.

    24.1The parent/guardian understands that soccer, athletic training, matches, tournaments, travel-related activities and use of sports facilities involve inherent and other risks, including running, jumping, rapid changes of direction, physical contact, falls, collisions, being struck by a ball or equipment, uneven surfaces, weather exposure, heat, smoke, dehydration, overexertion, equipment failure and acts of other participants.

    24.2Potential injuries include bruises, cuts, sprains, strains, fractures, dental or eye injury, concussion, heat illness, cardiac events and, although uncommon, catastrophic injury, permanent disability or death.

    24.3The parent/guardian knowingly and voluntarily assumes the inherent risks of participation on behalf of themselves and, to the extent legally permitted, the participating minor, including risks that cannot be completely eliminated without changing the essential nature of soccer and athletic participation.

    24.4RELEASE OF ORDINARY NEGLIGENCE. To the fullest extent permitted by California law, the parent/guardian, for themselves and to the extent they may lawfully do so on behalf of the participating minor, releases and agrees not to hold liable EPAC, its owners, officers, employees, coaches, contractors, volunteers, agents and affiliated programme personnel for claims for personal injury, death or property damage arising from the ordinary negligence of a released party and occurring within the scope of participation in an EPAC activity or use of an EPAC-arranged facility, except to the extent a claim cannot legally be released.

    24.5This release is intended to be clear and explicit. It includes ordinary negligence associated with coaching, supervision, instruction, field or equipment conditions, organization of activity and other ordinary operational acts or omissions within the lawful scope of a recreational sports release.

    24.6This release does NOT apply to gross negligence, reckless or intentional misconduct, fraud, violation of non-waivable law, or any other liability that California law does not permit to be released.

    24.7The parent/guardian understands that EPAC does not control every risk created by other players, spectators, officials, venue owners, tournament operators, transportation providers or other independent third parties and voluntarily accepts the ordinary risks of interacting with such persons and facilities as part of participation, subject to applicable law.

    24.8If a separate participant waiver or event-specific release is presented, it supplements these Terms. If provisions conflict, they will be interpreted to provide the broadest lawful protection consistent with applicable law without eliminating non- waivable rights.

    25. Indemnity and Responsibility for Participant Conduct

    25.1To the fullest extent permitted by law, the customer agrees to be responsible for and indemnify EPAC against third-party claims, property damage, losses or reasonable costs directly caused by the customer's or player's intentional misconduct, unlawful conduct, fraud, deliberate property damage or material breach of these Terms.

    25.2This indemnity does not require the customer to indemnify EPAC for EPAC's own gross negligence, reckless or intentional misconduct, or any liability that cannot lawfully be shifted to the customer.

    25.3The customer is responsible for ensuring that guests, relatives and spectators attending at their invitation comply with applicable venue and conduct rules. EPAC may require such persons to leave an activity where necessary for safety or programme operation.

    26. Disclaimers, Limitation of Liability and Non-Guaranteed Outcomes

    26.1Coaching involves professional judgment and individual development varies. EPAC does not guarantee any specific rate of improvement, team selection, Academy selection, EPAC FC selection, playing time, tournament selection, college recruitment, scholarship, scout contact, professional contract or other sporting result.

    26.2To the fullest extent permitted by law, EPAC is not liable for indirect, incidental, special or consequential loss arising from participation or inability to participate, including lost opportunity, lost travel bookings, missed club activity, disappointment from non-selection or third-party costs, except where such limitation is prohibited by law.

    26.3EPAC is not responsible for acts or omissions of independent third parties such as venue operators, tournament organizers, governing bodies, hotels, airlines, transportation providers, payment processors or technology providers except to the extent EPAC is legally responsible for its own conduct in selecting or dealing with them.

    26.4Nothing in these Terms excludes, restricts or modifies a consumer right or remedy that cannot lawfully be excluded, restricted or modified.

    27. Legal Terms, Severability and Governing Law

    27.1These Terms and incorporated programme information constitute the agreement concerning the relevant EPAC service, together with any separate signed waiver, medical authorization, payment authorization, Privacy Policy or event-specific agreement that expressly applies.

    27.2If any provision is held invalid, illegal or unenforceable, the remaining provisions remain effective. Any affected provision will be interpreted or limited to the maximum extent lawfully enforceable where possible.

    27.3EPAC's failure to enforce a term on one occasion does not waive its right to enforce that term or another term later.

    27.4Headings and summaries are for convenience only and do not limit the meaning of the operative provisions.

    27.5These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not resolved informally will be subject to the courts and lawful procedures applicable in California unless the parties separately agree in writing to another lawful dispute-resolution method.

    27.6Nothing in these Terms requires a customer to waive a statutory right that cannot lawfully be waived in advance.

    28. Changes to Terms and Notices

    28.1EPAC may update these Terms for future registrations, programme periods, renewals or services. Material changes affecting an existing recurring Membership will be communicated before they take effect where required by applicable law.

    28.2A fee increase for an existing automatically renewing Membership will be communicated with the notice required by applicable law before the new amount is charged.

    28.3Operational notices may be sent by email, text message, booking platform, app, website notice or another contact method provided by the customer. Customers are responsible for keeping contact details current and monitoring programme communications.

    28.4Questions concerning these Terms, billing or programme administration may be directed to conrad@premieracademycoaching.com. Booking-related questions may be directed to bookings@epacsoccer.com.

    29. Parent / Customer Acceptance and Acknowledgements

    By electronically accepting these Terms, signing below, making payment, booking a service, or allowing a player to participate after receiving access to these Terms, the parent/customer confirms each of the following:

    • I have read and understood these Terms and agree to be bound by them.
    • I have authority to register the participating minor and provide the consents and authorizations contained in these Terms.
    • I understand the payment, recurring billing, cancellation and no-show rules that apply to the service I purchase.
    • I understand that Founding Member pricing can be lost following a failed, missed, reversed or unpaid Membership payment or cancellation/lapse.
    • I understand that Academy instalments are a payment plan for a full programme commitment, not a month-to-month Membership.
    • I understand that Training does not guarantee Academy selection and Academy does not guarantee EPAC FC selection or any particular sporting outcome.
    • I have disclosed relevant medical information and will update EPAC if it changes.
    • I authorize reasonable emergency medical action if I cannot be reached.
    • I understand EPAC may remove a player following suspected concussion, cardiac symptoms, illness or another safety concern and may require medical clearance before return.
    • I acknowledge and voluntarily assume the inherent risks of soccer and athletic participation.
    • I have read Section 24, including the release of claims arising from ordinary negligence to the fullest extent permitted by California law.
    • I understand the release does not waive claims that cannot legally be waived, including gross negligence or intentional misconduct.
    • I agree to the player, parent, spectator, safeguarding and conduct rules.
